Judge Ross B.H. Buchanan denied Clayton Early Learning motion to dismiss on November 30 2018 and Clayton filed its answer to the amended complaint on December 7 2018

The parties will now engage in discovery and unless the case is settled it will go to trial. Due to the types of claims made by Arcis—and particularly the “duty of good faith and fair dealing” claim

The pretrial order requires the parties to secure a trial setting from the court clerk no later than December 21 and states that the trial date must be scheduled to begin no later than May 15, 2019 [one year after the filing of the original complaint].
