The following motion was voted on at the INC Zoning and Planning meeting August 22, 2015 and will be presented at the next INC Delegate meeting September 12, 2015

Neighborhood representatives recently became aware of an action by the Department of Excise and Licenses that deeply disappointed us and threatens to undermine the collaboration that neighborhood representatives thought we had developed with Excise and Licenses during the last 8 years. Specifically, we learned that someone posted on the E & L website a 1-page document setting out pre-hearing procedures and hearing procedures for Evening Hearings for Liquor, 3.2 beer and Cabaret Licenses.

- The document is unsigned.
- Registered Neighborhood Organizations were never notified that such a document was being drafted or asked for any involvement in the drafting, even though RNO representatives, along with liquor industry representative, worked collaboratively with E & L during 2009 and again in 2013 to develop the Rules and Regulations for Liquor, 3.2 Beer and Cabaret Licenses.
- RNOs were not even notified of the fact that the document had been approved and posted, until one RNO received a Scheduling Order shortly before an evening hearing was scheduled, which caused considerable additional work and stress for the RNO.
- RNOs have still not been officially notified of the apparent adoption of the new regulation.
No explanation is given in the document for why evening hearings should have any different procedures than daytime hearings. - Neighborhood representatives value the opportunity to request, on rare occasions, evening hearings which enable greater attendance and participation by citizens, many of whom find it difficult to take several hours during daytime working hours to participate. This document appears designed to place greater burdens on citizens and neighbors.
We request that the Department of Excise and Licenses promptly
- respond in writing to the above points
- reconvene the working group from 2013 to discuss together whether this document should be rescinded or modified and
- consider other ways that the Department can rebuild public trust and confidence in the Department.
